ProFuturo Foundation, with Tax ID No. G-87620134, and registered in the State Registry of Foundations under No. 1,856 (hereinafter, “ProFuturo”), reserves the right to modify this Privacy Notice in order to adapt it to new legislation, case law, guidelines from supervisory authorities, industry practices, or organizational interests. Any modifications will be published on this same page well in advance so that users may review their content.

This Privacy Notice provides information regarding the processing of personal data collected through the website https://profuturo.education/, in accordance with Regulation (EU) 2016/679, the General Data Protection Regulation, and Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights.

III. WHAT PERSONAL DATA DO WE PROCESS?

ProFuturo processes the personal data that users provide directly through the forms available on the website, specifically:

V. FOR WHAT PURPOSES DO WE PROCESS YOUR DATA, AND WHAT IS THE LEGAL BASIS?

1. Management of the contact form

Purpose: to manage and respond to contact requests or requests for information submitted through the website.

Legal basis: the consent provided by the data subject by accepting the corresponding form and, where applicable, the implementation of precontractual measures at the data subject’s request.

2. Management of Resource Requests for Institutions

Purpose: to manage requests from organizations for access to or use of educational resources, assess their suitability, and maintain the necessary communications related to such requests.

Legal basis: the consent provided by the data subject by accepting the corresponding form and, where applicable, the implementation of pre-contractual measures at the data subject’s request.

3. Use of your image:

Purpose: use of visual material to publicize the Foundation’s activities on social media, websites, newsletters, etc.

Legal basis: the consent provided by the data subject by accepting the corresponding form

4. Management of the newsletter subscription

Purpose: to send the ProFuturo newsletter and informational communications.

Legal basis: the consent provided by the data subject.

5. Participation in initiatives or calls for proposals

Purpose: to manage the receipt, evaluation, selection, and participation in initiatives, calls for proposals, or activities promoted by ProFuturo, such as Hack4Edu.

Legal basis: the implementation of pre-contractual measures and/or the fulfillment of the terms of participation accepted by the data subject. The sending of additional communications will be based, where applicable, on the consent provided by the data subject.

6. Additional Communications from ProFuturo

Purpose: to send information about ProFuturo’s activities, events, publications, or initiatives when the user has expressly consented.

Legal basis: the consent granted by the data subject.

VI. HOW LONG DO WE RETAIN YOUR DATA?

Personal data will be retained for as long as necessary to fulfill the purpose for which it was collected and, thereafter, for the applicable legal retention periods and statutes of limitations for liability.

In the case of processing based on consent, the data will be retained as long as the user does not withdraw such consent or request its deletion, without prejudice to its subsequent blocking for the legally required periods.

VII. WHO MAY RECEIVE YOUR DATA?

Personal data will not be transferred or disclosed to third parties, unless required by law.

However, ProFuturo works with third-party service providers who may access personal data in their capacity as data processors, such as providers of technology, hosting, maintenance, support, or communication services.

In general, no international data transfers are anticipated for contact processing, institutional resources, or participation in initiatives, unless they result from the use of technology providers and are duly regulated.

However, in the event that providers are used that involve the processing of personal data outside the European Economic Area, ProFuturo guarantees that the necessary measures and safeguards will be adopted to ensure that such processing is carried out with a level of protection essentially equivalent to that established by European data protection regulations, either because the provider offers adequate safeguards—including, among other things, by entering into the Standard Contractual Clauses approved by the European Commission—or because one of the exceptions provided for in current regulations applies.

IX. SECURITY OF PERSONAL DATA

ProFuturo will implement appropriate technical and organizational measures in its information system, in accordance with the principle of proactive responsibility, to ensure the security and confidentiality of stored data, thereby preventing its alteration, loss, unauthorized processing, or unauthorized access; taking into account the state of the art, the costs of implementation, and the nature, scope, context, and purposes of the processing, as well as the varying likelihood and severity of the risks associated with each processing operation.

X. WHAT ARE YOUR RIGHTS?

You may exercise the following data protection rights with ProFuturo:

the right of access to your personal data to find out which data are being processed and the processing operations carried out on them;
the right to rectification of any inaccurate personal data;
the right to erasure of your personal data, when possible;
the right to request the restriction of processing of your personal data when the accuracy, lawfulness, or necessity of the data processing is in doubt; in such cases, ProFuturo may retain the data for the purpose of asserting or defending legal claims;
right to data portability of your personal data, so that it may be transmitted directly to the entity you designate in a structured, commonly used, and machine-readable format;
right to object to the processing of your personal data, when the legal basis is legitimate interest. For these purposes, ProFuturo will cease processing your data unless it has an overriding legitimate interest or for the purpose of establishing, exercising, or defending legal claims;
right to withdraw your consent at any time.
